LEGISLATIVE ALERT NEW CELL PHONE LAW GOES INTO EFFECT APRIL 1, 2008.
The Governor for the state of NJ has signed into
law an amendment to NJSA 39:4-97.3, Use of a Cell Phone in a Motor Vehicle.
The new law, set forth fully below, now makes the use of a cell phone,
without a hands free set, or a text message, a primary offense which means
the police may pull a driver over and issue a summons for only that reason
(previously, there had to be another primary offense to pull a vehicle over
and the cell phone could only be issued as a secondary ticket).
Additionally, the new law significantly increases fines for the offense and
makes an offense a prior conviction for unsafe driving (39:4-97.2) for which
an individual can only receive 2 summons in a five year period without
receiving points (any others convictions during the five year period for
unsafe driving and it is a 4 point summons). This is a major revision to
the law and could have a major impact to the public (especially as to
